If your crews are tying steel and setting formwork for foundations, piers, or retaining walls this fall, rebar impalement protection requirements aren't optional paperwork — they're one of the fastest ways to end up in front of an OSHA compliance officer after a fall. Every foundation season I get calls from GCs and concrete subs in NJ, NY, and PA who assumed a few orange caps on the rebar mat covered them. It doesn't, and OSHA has issued multiple standard interpretations over the years specifically because contractors get this wrong.

What OSHA 1926.701(b) Actually Requires

The rule itself is short: "All protruding reinforcing steel, onto and into which employees could fall, shall be guarded to eliminate the hazard of impalement." Short doesn't mean simple. OSHA has clarified in standard interpretations that this applies to vertical dowels, horizontal protrusions, rebar in beam stirrups, and any other sharp projection an employee could fall onto — not just the classic vertical column dowel scenario most crews picture. If a worker could fall from height, or even trip and fall onto exposed steel at grade, guarding is required.

The performance standard OSHA applies to caps, covers, and troughs is a 250-pound object dropped from 10 feet without penetration. Snap-on plastic caps rated for scratch protection only — the kind sold in bulk at most supply houses — do not meet this standard on their own for fall-exposure areas. If your site uses them purely as puncture guards in walking areas with no fall exposure, that's a different conversation than protecting a rebar mat under a formed deck pour.

Formwork and Shoring Requirements Under 1926.703

Rebar impalement protection doesn't exist in isolation — it's usually tied to formwork and shoring operations happening at the same time. 1926.703 requires that formwork be designed, fabricated, erected, supported, braced, and maintained so it can support all vertical and lateral loads during the pour without failure. Drawings for jacks, shoring equipment, and forms need to be available at the jobsite when required by the standard, and no construction loads should be placed on a concrete structure until the concrete has cured sufficiently, based on the field data and test results your engineer of record has signed off on.

Reshoring and shore removal are where I see the most exposure. Crews strip forms on schedule pressure without confirming cure strength, or they pull shoring in a sequence the structural engineer never approved. That's a concrete formwork safety failure that can collapse a deck, not just an impalement hazard — and it's exactly the kind of thing OSHA's Construction Group investigates after a structural failure with injuries.

Post-Tensioning Operations

If your concrete construction safety program covers post-tensioned slabs, 1926.701(e) requires that no one be permitted to be behind the jack during tensioning operations, and that signs and barriers be used to keep employees out of the hazard area while tendons are under tension. Post-tensioning failures are rare, but they're catastrophic when they happen — this is not a section to skip in your written program just because it doesn't apply to every job.

Here's what needs to be in place before the next pour on any job with exposed reinforcing steel:

  • Rebar caps, covers, or troughs rated to the 250-pound/10-foot performance standard wherever fall exposure exists over protruding steel
  • A documented inspection of rebar mats and dowels before each shift where employees will be working above or near them
  • Engineer-approved formwork, jacking, and shoring drawings on site and available to the crew and any inspecting authority
  • A written reshoring and stripping sequence tied to actual cure data, not just calendar days
  • Barricades and signage restricting access behind post-tensioning jacks during tensioning
  • Toolbox talk documentation showing the crew was briefed on impalement hazards before steel-setting begins
