Every summer I see the same thing on demo sites across Jersey and the boroughs: torches cutting steel, grinders throwing sparks, crews moving fast to hit a schedule — and a fire watch standing there with a phone in one hand instead of an extinguisher. That's not a paperwork problem. That's how a job trailer, a dumpster full of debris, or a half-demolished structure ends up on fire while a crew is still inside it. Hot work is one of the leading causes of structure fires on construction and demolition sites, and OSHA has a specific standard for it — 29 CFR 1926.352, Fire Prevention. If you're cutting, welding, brazing, or grinding on a demo site in NJ, NY, or PA, you need to know exactly what this standard requires, because insurers and AHJs are checking it as closely as OSHA is.
What Actually Counts as Hot Work
Hot work isn't limited to arc welding. Under 1926.352, it covers any operation that produces open flame, sparks, or enough heat to ignite nearby combustibles — cutting torches, oxy-acetylene, plasma cutters, angle grinders on steel, and even some demolition saws throwing sparks on masonry cuts. On a demolition site this comes up constantly: cutting rebar, separating structural steel for salvage, torching bolted connections, or grinding out embeds. If the tool produces sparks, slag, or flame and there's combustible material within range, you're in hot work territory and the standard applies.
The 35-Foot Rule and What a Fire Watch Actually Has to Do
1926.352(a) requires that combustible material be moved at least 35 feet from the work, or protected with fire-resistant covers, whenever hot work is performed and relocation isn't practical. On a demo site, that means tarps, debris piles, plywood, and anything soaked in solvent or fuel don't get to sit near the cut. Where those combustibles can't be moved — which is most demolition work — 1926.352(e) requires a fire watch. That person's only job during hot work is to watch for fires: not running material, not holding the drop cloth, not on their phone. A fire watch needs to be trained on the specific fire hazards of the area, know how to sound the alarm, and have a suitable extinguisher within reach at all times. If sparks can drop through floor openings, wall cavities, or into the level below — which happens constantly in phased demolition — the fire watch has to cover those exposures too, which sometimes means posting more than one watch.
The 30-Minute Rule Nobody Follows
This is the part I see skipped most on demo jobs: 1926.352(e) requires the fire watch to stay in place for at least 30 minutes after hot work is completed. Smoldering slag in insulation, wood framing, or debris can flare up well after the torch is shut off and the crew has moved on to the next cut. If your crew is finishing hot work and walking off the floor immediately, you're out of compliance and you're carrying real fire risk into an unoccupied structure — which is exactly the scenario that turns into a total loss.
Contractors in NJ specifically should also know that many municipalities require a hot work permit issued by the local fire marshal before cutting or welding begins on a demolition site, separate from anything OSHA requires. That permit process usually verifies the same things — extinguisher placement, combustible removal, fire watch assignment — so getting your OSHA program right typically gets your local permit right too.
What You Need in Place Before the Torch Gets Lit
- A written hot work permit process, issued before cutting, welding, or grinding begins on each shift or area
- Combustibles cleared 35 feet from the work area, or covered with fire-resistant material where they can't be moved
- A charged, appropriate fire extinguisher within immediate reach of every hot work location
- A dedicated fire watch — not a laborer doing double duty — trained on the specific hazards of that area and equipped to sound an alarm
- Fire watch coverage for adjacent floors, cavities, or spaces where sparks or heat can travel
- A documented 30-minute post-work monitoring period before the fire watch stands down
- Local hot work permits pulled where required by the municipality or fire marshal
