Falls from elevated platforms are one of the most preventable — and most cited — hazards on construction sites in New Jersey, New York, and Pennsylvania. A big part of the problem isn't reckless behavior. It's confusion. Contractors routinely assume aerial lifts and scissor lifts fall under the same OSHA rule, and that mistake shows up on citation reports every year. Aerial lift and scissor lift safety requirements are actually governed by two different sections of 29 CFR 1926, and if your crew doesn't know which rule applies to which machine, you're exposed the moment an inspector or an insurance auditor shows up.

This matters right now because elevated work platforms are everywhere on demolition, GC, and heavy civil jobs — from boom lifts reaching upper floors to scissor lifts used for MEP rough-in and ceiling work. Getting the distinction wrong isn't a paperwork issue. It changes what fall protection is required, what pre-use inspection looks like, and who's allowed to operate the equipment.

Aerial Lifts Fall Under 1926.453 — Scissor Lifts Do Not

OSHA's aerial lift standard, 1926.453, covers boom-supported platforms: articulating boom lifts, telescoping boom lifts, and similar vehicle-mounted equipment built to the ANSI A92.2 design standard. Scissor lifts are a different animal. Because they don't meet the ANSI A92.2 definition of an aerial lift, OSHA classifies them as mobile scaffolds and regulates them under 1926.451 and 1926.452(w) — the same scaffold standard your crew already deals with on other parts of the job.

Why it matters: the training, inspection, and fall protection obligations aren't identical between the two. Treating a scissor lift like an aerial lift — or vice versa — in your written program is the kind of gap that shows up during a claim investigation or an ISNetworld review, not just an OSHA visit.

Fall Protection Requirements for Each Lift Type

For boom-type aerial lifts, 1926.453(b)(2)(v) requires workers to be tied off to the boom or basket with a body harness and lanyard whenever they're in the elevated platform — a guardrail alone doesn't satisfy this. For scissor lifts, the standard control is the built-in guardrail system, though workers should still be tied off when the guardrail is compromised, removed, or when jobsite conditions call for it. Your JHA should spell out which control applies to which piece of equipment on that specific site — not a blanket policy that assumes one rule fits every lift type.

Operator Training and Pre-Use Inspection

Every operator needs documented training specific to the type of lift they're running, and that training has to cover the manufacturer's operating manual — not just general lift safety talking points. Before each shift, a competent person needs to complete and document a pre-use inspection: hydraulic lines, tires, outriggers, guardrails, emergency lowering controls, and the ground conditions the lift will be operating on. Ground conditions are a common miss. Soft, sloped, or uneven ground is one of the leading causes of aerial lift tip-overs, and it belongs on the inspection checklist, not treated as an afterthought.

What NJ, NY, and PA Contractors Need in Place

  • A written elevated work platform policy that separately addresses aerial lifts (1926.453) and scissor lifts (1926.451/452(w))
  • Documented, equipment-specific operator training for every lift model in use on site
  • Daily pre-use inspection logs signed by a competent person, including ground condition checks
  • Fall protection procedures matched to lift type — tie-off for boom lifts, guardrails with tie-off contingencies for scissor lifts
  • A maintenance and repair log showing manufacturer-recommended service intervals
  • Site-specific rules for lift use near overhead power lines, floor edges, and other struck-by or fall hazards
